Terms of Service

These Terms of Service govern purchases from and use of EtchedWorks and etchedworks.com. By placing an order, approving custom artwork, or using our website, you agree to these Terms and any policies referenced below.

Custom and Personalized Products

EtchedWorks specializes in custom engraved, etched, personalized, and made-to-order products.

Because custom products are produced specifically for each customer, they generally cannot be resold. Customized products are therefore subject to our Returns, Cancellations & Custom Order Policy and Artwork & Proof Approval Policy.

Once artwork has been approved or production has begun, custom orders are generally final sale and cannot be cancelled, returned, or exchanged except where required by law or when EtchedWorks determines that a product was damaged, defective, or incorrectly produced.

Artwork and Proof Approval

Customers are responsible for reviewing any artwork proof provided by EtchedWorks before approving production.

Approval confirms that the customer has reviewed and accepted the spelling, names, dates, wording, artwork, logos, layout, placement, and other personalization shown on the proof.

EtchedWorks is not responsible for customer-supplied errors that appear on an approved proof.

Once you approve it, we produce it.

If EtchedWorks produces an item that materially differs from the approved proof because of our error, we will review the issue in accordance with our applicable order policies.

Customer-Supplied Content

By providing EtchedWorks with a logo, photograph, artwork, trademark, text, design, or other material for reproduction, you represent that you own the material or have permission or other legal authority to use and reproduce it.

You agree not to submit material that infringes another person's intellectual-property or other legal rights.

EtchedWorks reserves the right to decline any personalization, artwork, wording, or order that we reasonably believe we should not reproduce.

Product Appearance

Because engraving, etching, glassware, bottles, and other materials can vary, minor differences may occur between digital proofs, website photographs, samples, and finished products.

These may include reasonable variations in etching depth, engraving appearance, positioning, glass thickness, bottle shape, material texture, color, finish, and manufacturer markings.

Such normal production and material variations are not considered defects.

Pricing and Payment

Prices are displayed in U.S. dollars unless otherwise indicated.

Applicable taxes, shipping charges, rush charges, artwork charges, setup fees, and other applicable charges may be added to the order.

EtchedWorks reserves the right to correct genuine pricing, typographical, or product-description errors. If a material pricing error affects an order before production, we will contact the customer before proceeding.

Payment must be successfully completed according to the payment terms presented when the order is placed.

Order Acceptance

Submitting an order does not necessarily constitute final acceptance by EtchedWorks.

We reserve the right to decline or cancel an order before production for reasons including product availability, inability to complete the requested customization, suspected fraud, pricing or listing errors, or other legitimate business reasons.

If EtchedWorks cancels an order that has been paid and no charge is otherwise properly owed, the applicable payment will be refunded.

Cancellations

Orders cancelled before artwork, setup, sourcing, or production work begins may be eligible for a full refund.

Once design, artwork, setup, or sourcing work has begun, applicable costs may be deducted from any refund.

Once production has begun, custom orders generally cannot be cancelled.

Products specially sourced or ordered for a particular customer may become non-cancellable once EtchedWorks commits to purchasing them.

Production and Delivery

Production time begins after EtchedWorks has received all information necessary to complete the order, including final artwork approval when required.

Production and delivery dates are estimates unless EtchedWorks expressly guarantees a specific date in writing.

EtchedWorks is not responsible for reasonable delays caused by circumstances outside our control, including carrier delays, severe weather, transportation disruptions, supplier delays, natural disasters, governmental actions, or similar events.

Customers ordering for a wedding, birthday, corporate event, holiday, or other time-sensitive occasion should provide the required date and place the order sufficiently in advance.

Shipping

Customers are responsible for providing complete and accurate shipping information.

Additional costs caused by an incorrect customer-supplied address, refused shipment, rerouting request, or reshipment may be charged to the customer.

Shipping damage and delivery problems should be reported promptly in accordance with our Shipping & Delivery Policy.

Damaged, Defective, or Incorrect Products

Customers should inspect their orders promptly upon delivery.

Damage, defects, or material production errors should be reported to EtchedWorks within 48 hours of delivery, together with requested photographs and supporting information.

When EtchedWorks determines that an item was damaged, defective, or incorrectly produced, we may provide an appropriate repair, replacement, reproduction, or refund.

Nothing in these Terms is intended to eliminate rights or remedies that cannot legally be waived.

Intellectual Property

Unless otherwise stated, the EtchedWorks name, website content, original photographs, graphics, designs, written material, and other original content created by EtchedWorks are owned by or licensed to EtchedWorks and may not be reproduced or commercially used without permission.

Customer-owned logos, trademarks, and artwork remain the property of their respective owners.

Producing customer-supplied artwork does not transfer ownership of that artwork to EtchedWorks.

Website Information

We make reasonable efforts to present accurate product descriptions, photographs, pricing, and other website information.

Because computer displays vary and many products involve natural or manufactured material variations, we cannot guarantee that a customer's screen will display every color, texture, finish, or physical characteristic exactly as it appears on the finished product.

Prohibited Use

You may not use our website or services for unlawful purposes, to violate another person's rights, to submit fraudulent information, to interfere with website operation, or to attempt unauthorized access to our systems or services.

Limitation of Liability

To the fullest extent permitted by applicable law, EtchedWorks will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase or use of our products or website.

Where permitted by law, EtchedWorks' aggregate liability arising from a particular order will not exceed the amount paid to EtchedWorks for the product or order giving rise to the claim.

These limitations do not apply where prohibited by applicable law.

Other Store Policies

Our Returns, Cancellations & Custom Order Policy, Artwork & Proof Approval Policy, Shipping & Delivery Policy, and Privacy Policy are incorporated into these Terms where applicable.

Changes to These Terms

EtchedWorks may update these Terms from time to time.

The version in effect when an order is placed will generally govern that transaction unless applicable law requires otherwise.
